James Comey Indicted, Memo Suggests He’ll Walk Free…Here’s Why

The swamp is not going quietly, and the latest leak out of the Eastern District of Virginia proves it. On Wednesday evening, disgruntled officials in the U.S. Attorney’s office reportedly leaked a memo arguing against bringing charges against former FBI Director James Comey. The timing is no accident. With just days left before the statute of limitations expires, this looks like one last-ditch effort to shield one of the Left’s favorite “heroes” from facing accountability.

James Comey was formally indicted for lying to Congress in his September 30, 2020 testimony about whether he authorized leaks to the media. Remember those infamous memos he wrote after meetings with President Trump? They didn’t magically appear in the New York Times. Comey leaked them through his Columbia law professor pal, Daniel Richman, and those leaks conveniently triggered the Mueller investigation. Yet, under oath, Comey denied authorizing such leaks. That’s the problem.

Now that President Trump has replaced Erik Siebert, the U.S. Attorney for the Eastern District of Virginia who refused to bring charges against Comey, Letitia James, and Adam Schiff, the tables are turning. Trump appointed Lindsey Halligan, his attorney who defended him against the unconstitutional Mar-a-Lago raid, to take over the office. Halligan is reportedly preparing the indictment against Comey before the clock runs out.

Enter the leaked memo. According to MSNBC’s Ken Dilanian, prosecutors in the office handed Halligan a document explaining why they believe Comey shouldn’t be charged. Their reasoning? They claim there isn’t enough evidence to establish probable cause, much less secure a conviction. They also pointed to DOJ guidelines requiring a “reasonable probability” of conviction before bringing charges.

Let’s cut through the noise. This is classic bureaucratic foot-dragging from a DOJ that has spent years protecting its own. If this were anyone but James Comey, they’d already be in court. The man literally admitted to orchestrating leaks through a friend to get a special counsel appointed against a sitting president. If lying under oath to Congress about that doesn’t rise to the level of prosecution, then what exactly does?

What’s clear is that President Trump’s decision to bring in Lindsey Halligan rattled the cage. The leaks, the memos, the spin, they’re all part of the swamp’s playbook to keep their insiders safe. But time is running out, and Comey’s legal troubles may soon be front and center. Accountability delayed isn’t accountability denied, and Comey may finally be learning that lesson.
