Supreme Court Shock as Liberal Justice Sides Against Illegal Immigrants in Emergency Case

Well, well, well — look who suddenly remembered what the law says. In a move that shocked exactly everyone who’s paid attention to her judicial track record, liberal Supreme Court Justice Elena Kagan just denied an emergency application to stop the deportation of a Mexican family of four who entered the U.S. illegally back in 2021.

That’s right — Kagan, one of the Left’s most reliable votes on the bench, let the deportation stand without comment. No impassioned dissent, no legal acrobatics, no “living Constitution” footnote. Just a flat-out denial. And while she didn’t explain her reasoning, the silence speaks volumes. Even she couldn’t justify blocking the removal of a family whose asylum claims had been denied at every single level — from the immigration judge, to the appeals board, to the famously liberal Ninth Circuit Court of Appeals. That’s the judicial equivalent of striking out three times with the bases loaded.

Here’s the deal: Fabian Lagunas Espinoza, Maria Angelica Flores Ulloa, and their two sons illegally crossed the border in 2021. Their excuse? Fleeing cartel violence. And listen, no one’s denying Mexico has a cartel problem — but asylum law is not a catch-all pass for anyone who’s afraid of a dangerous neighborhood. You need to show specific, targeted persecution based on race, religion, political opinion, or group status. Being threatened by thugs in a lawless town doesn’t automatically qualify.

And in this case, that’s exactly what the courts ruled. The family’s claim didn’t meet the legal threshold. The judge said no. The appellate court said no. The Ninth Circuit said no. And now even Elena Kagan said nope. That’s not right-wing cruelty — that’s the legal process playing out under the actual rule of law.

So while Biden’s DHS is busy playing musical chairs with catch-and-release, and Democrat senators are out here flying to El Salvador to defend MS-13 members, here comes a rare reminder that even a liberal Supreme Court justice can’t pretend every deportation is some kind of human rights violation.

The Left loves to scream about “compassion” and “humanity,” but justice without law is just chaos. And for once, it seems even Kagan knows that. Maybe there’s hope for the courts after all — or maybe this family’s legal team just picked the wrong PR angle.

Either way, it’s a win for the rule of law.
